Schedule of Hire

The Schedule of Hire is an offer made by Us (MGB Backline Pty Ltd abn: 26 149 706 598), to provide the items in the Schedule of Goods and Additional Services to You (The hirer named in the Schedule of Hire). By signing the Schedule of Hire, You agree to be bound by the Terms and Conditions.

We (MGB Backline Pty Ltd abn: 26 149 706 598) agree to make the goods outlined in the Schedule of Goods available to you during the time\date noted as the Period of Hire including Additional Services, in exchange for the Amount Due as per the Payment Method and agreement to the Terms and Conditions.

If any item in the Schedule of Goods is damaged in any way, You breach the Terms and Conditions in any way, or You make any material misrepresentation to Us, We may recover or demand the immediate return of all items listed in the Schedule of Goods without providing compensation to You.

You are responsible for all loss or damage, however caused, of any item in the Schedule of Goods from the Start of the Period of Hire until all items in the Schedule of Goods have been returned to Us and We have signed the Confirmation of Return within the Schedule of Hire. In the event of any loss or damage You are required to pay to Us, the replacement value of the Schedule of Goods as determined by Us.

We will not be liable for any loss or injury, no matter how caused.

You will not allow any item in the Schedule of Goods to be repaired or altered in any way. Misuse of items in the Schedule of Goods is dangerous and is not permitted. Use of the items in the Schedule of Goods is at Your risk.

Services provided:

Our standard services quoted are:

Delivery/Pickup Only: This is a courier style flat load delivery or pickup unless specified otherwise. No allowance is made to set up or pack down the gear and a fee will be incurred in cases which our drivers are required to set up or pack down gear for any reason, determined in accordance with the charges which are set out below, which you agree to pay.

Setup: This allows for setup of the equipment only, unless otherwise specified waiting time incurred for soundchecks is not included unless specified by us. If access in any way is impeded making safe setup of gear difficult then an excess charge will be incurred for the time delay determined in accordance with our normal charges for this service. You agree to pay these charges.

Technicians: When requested our backline technicians are there to look after the backline gear, assist in stage changes and…… unless specified our technicians will not bring a vehicle with them to the show to make last minute pickups or gear changes so these will need to be called back to our office and thus will incur extra fees determined in accordance with our normal charges, which you agree to pay.

Charges – How calculated

For the purposes of this clause "job" means the delivery and installation of equipment the subject of this hire agreement.

We retain the right to charge You for any unforeseen or unintended changes to labour required by us for the safe and efficient dispatch, use, and return of our goods. A summary of these charges are as follows:

Delays to required access or prevention of undertaking or completion of tasks at any stage of a job from the time which we have been requested and booked in to arrive this incurs a fee starting at $80 per person we are providing per hour.

Unscheduled pack down fee starting at $200 dependant on size of job, location and time of pickup.

Unplanned short notice delivery fee starting at $120 when extra items are required which have not been previously requested or replacements are required for gear that is not working properly due to user error.

Unplanned difficult load in/out fee starting from $100 dependant on size of job, location and difficulty of load in (usually unforeseen stairs and or stages).

Failure to provide manual assistance when stipulated in quote or conversation as required for load in of oversized/heavy items commencing fee $100

This summary of excess charges is not comprehensive and we retain the right to charge for any instances in which our time has been wasted, our safety or the safety of our gear has been compromised or our services are required with insufficient notice given.

Where You authorise any person to act on Your behalf to take possession of any item in the Schedule of Goods (including courier or carrier), that person acts on Your behalf when signing the Schedule of Hire, and constitutes Your acceptance of these Terms and Conditions.

Return/Exchange Policy

We strive to keep all our gear in great condition but if for any reason there is a problem with your gear that we can replicate while testing we will offer a refund for the faulty items. However we reserve the right to charge for any extra gear that is requested and any labour incurred in providing said gear if there is no fault or if there has been a mistake in the booking process. Our quotes describe all items you will receive and it is your responsibility to check and approve all quotes.

Unless previously agreed in writing, a job must be 'pre-paid'. This payment and/or any part thereof constitutes the acceptance of the job and becomes non-refundable.

Our prices and all other applicable charges will be shown on quotes as requested, this is because our prices are variable with duration of hire and use.

We reserves the right to impose additional charges for the period in which our gear is not returned after the scheduled date and will not be available for use by our other customers and for any extra labour incurred.

Privacy Policy

We take our customer’s privacy seriously and we will only collect, record, hold, store, disclose, transfer and use your personal information as outlined below. Data protection is a matter of trust and your privacy is important to us. We shall therefore only use your name and other information which relates to you in the manner set out in this Privacy Policy. We will only collect information where it is necessary for us to do so and we will only collect information if it is relevant to our dealings with you.

We will only keep your information for as long as we are either required to by law or as is relevant for the purposes for which it was collected.

When you hire from us, or otherwise provide us with your personal information through our hire form, the personal information we collect may include your:

  • Name
  • Email Address
  • Contact Number
  • Mobile Number
  • Business Type

You must only submit to us, our hire form, information which is accurate and complete and not misleading and you must keep it up to date and inform us of changes (more information below). We reserve the right to request for documentation to verify the information provided by you.

We will only be able to collect your personal information if you voluntarily submit the information to us. If you choose not to submit your personal information to us or subsequently withdraw your consent to our use of your personal information, we may not be able to provide you with our Services. You may access and update your personal information submitted to us at any time.

If you provide personal information of any third party to us, we assume that you have obtained the required consent from the relevant third party to share and transfer his/her personal information to us.

Use and Disclosure of Personal Information

The personal information we collect from you will be used to:

  • To facilitate your use of the Services
  • To process orders you submit through the hire form. Payments that you make through credit card will be processed by our agent;
  • To deliver the products you have hired
  • To update you on the delivery of the equipment and for customer support purposes;
  • Further, we will use the information you provide to administer your account (if any) with us; verify and carry out financial transactions in relation to payments you make
  • In exceptional circumstances we may be required to disclose personal information, such as when there are grounds to believe that the disclosure is necessary to prevent a threat to health, for law enforcement purposes, or for fulfillment of legal and regulatory requirements and requests.
Security of Your Personal Information

We strive to ensure that all information collected will be safely and securely stored. We protect your personal information by:

  • Restricting access to personal information
  • Maintaining technology products to prevent unauthorized computer access
  • Securely destroying your personal information when it is no longer needed for any legal or business purpose
